Tonight I am joined by Josh Jackson and John Bursill to discuss a number of issues of the day, leading with the landmark decision by an Australian Federal Court against the Australian film and television industry which was trying to make ISPs liable for the downloading habits of their customers.

“You can breach copyright in two ways. One is by directly breaching it, which the users did; and secondly you can authorise a breach of copyright, which you can sometimes do by putting people in a position where they can breach copyright,” Mr Lambrick said.

“Now what Australian Federation Against Copyright Theft (AFACT) had argued was that by providing its internet service, iiNet was putting its account holders in a position whereby they could breach copyright directly themselves.

“Justice Cowdroy found it wasn’t the ISP’s system that was responsible for the breach of copyright. It was actually the BitTorrent system which was the means by which copyright was breached.”

Schapelle CorbySchapelle Corby became a household name in Australia after her arrest in 2004 on charges of importing 4.2 Kg of marijuana into Bali.

Her subsequent trial and guilty verdict were covered extensively in the news, and in 2005 there was a groundswell of support from all over Australia due to the inconsistencies in the evidence against her, the main one being that the street value of marijuana in Bali is roughly one eighth of the Australian value. Why would someone take enormous risks to import a drug into a foreign country for a massive loss?

The weakness of the case against Schapelle was compounded by the fact that the Indonesian prosecutors could not offer a single piece of forensic evidence to support their case, despite repeated requests from Corby’s defense team. The marijuana was not tested for its origin, finger prints were not taken and CCTV footage was mysteriously unavailable.

The case against Schapelle was based exclusively on circumstantial evidence, bolstered by (disputed) claims that her behaviour during the initial search demonstrated guilt.

The final twist was a “trial by media” which occured after Australian television program “Today Tonight”  payed Jodie Power $100,000 cash to air extremely damaging allegations about Schapelle’s sister Mercedes and the Corby family.

In May 2008, a New South Wales Supreme Court jury found that Channel Seven defamed Mercedes Corby, after which Seven Network settled the case for an undisclosed sum.

Schapelle’s mental state is reported to have deteriorated dramatically in the past year. Psychiatrist Jonathan Phillips visited Schapelle in jail earlier this year, and described her condition as follows:

“She is lost in her own bewildering world where fantasy, hallucinations and bizarre ideas dominate her mind… I really fear for her.”

“I know from experience that her illness will not get any better in the current situation, and will probably worsen with the risk of calamity.”

“Whether she’s innocent or guilty, her needs are medical.”

“She is in huge trouble.”

“I’ve never known a similar situation before and the things that might go wrong are beyond reckoning.”

Tonight TNRA welcomes Roy Reeves, a close friend of the Corby family, to discuss these issues and the miscarriage of justice which now threatens Schapelle’s life.

What is “Free Energy”?

This is a highly controversial term, even amongst those who believe it is possible to extract large and useful amounts of energy by unconventional means. The word Free could imply there is no cost and is somehow magical. That is not correct, perhaps cheap is a better term; and the well-documented science behind many of them certainly is not magic. These devices will of course cost money, and there will be significant limitations to their efficiency and effectiveness; especially until they are developed further.

Free also pertains to the fact that they are all pollution free, using no external chemical fuels and often requiring much less electricity to operate than they output (or least being much more efficient than traditional means). But perhaps the most accurate use of the word Free would relate to the change in society that these inventions would bring: Freedom from the electrical grid and filling stations Freedom from an economy built on scarcity. And freedom from the need to pollute our planet to maintain a high level of civilization.

In the final segment of the show I review the film “The International“, with a short clip and some commentary.

Film trivia: An explosive shootout scene takes place inside New York’s famous Guggenheim Museum, in which the museum appears to take severe damage. To film the scene, the film’s production team used the Guggenheim’s original blueprints to build a full-size replica of its interior in an old abandoned locomotive warehouse. Construction of the replica took 4 months.

On December 27th while at the airport, returning from a research trip from Texas and Oklahoma, I received a call from a friend who said he had just turned on the television and saw something he thought would be of interest to me. He excitedly told me that the FBI had just released a surveillance tape, long held in secrecy, to the Oklahoma City National Memorial commemorating the 1995 bombing of the Murrah federal building which killed at least 168 people. For unknown reasons this video was never released to the public, was not allowed in the three bombing trials of Terry Nichols or Timothy McVeigh and remained in the sole custody of the FBI until now. A spokesperson for the memorial said that the video will help to tell the story of the bombing more completely. I had just returned from Perry, Oklahoma where the footage was taken, a few days before learning of the release of the tape. My reasons for going to Perry were also to tell the story of the Oklahoma City bombing more fully, and an exploration of Perry seemed to be one of the ways to do this.

UFOlogists don’t like to talk about bigfoot. Cryptozoologists looking for sasquatch don’t like talking about ghosts. Ghost hunters won’t talk about UFOs. And conspiracy researchers are constantly lamenting, and rightfully so, being linked to all of the above by the media as a discrediting tactic. It’s a fair criticism (for those not wishing to taint there own activist chocolate with those other fringers’ peanut butter.)

A corollary criticism often follows that television shows and movies with wacky paranormal conspiracy subjects generally condition the public to associate those topics and issues with so much silly entertainment. And again, I generally agree with that sentiment.

But some TV shows and movies can make excellent touchstones for educating that same neophyte public about both the paranormal and parapolitical. And while our myth-making media do condition the public to pigeon-hole conspiracy claims and UFO sightings research into the molds sculpted in the image of X-Files “True Believers,” some examples from these pop-culture continuums can be turned back on themselves as vast repositories of referential material and launchpads for further exploration. These exemplary cult-classics can serve to educate instead of obfuscate. For there are many True Believers and they each have their own cliques, but there are also those watching all the various cliques - and those watchers aren’t all working for the NSA.
