Tonight I am joined by Josh Jackson and John Bursill to discuss a number of issues of the day, leading with the landmark decision by an Australian Federal Court against the Australian film and television industry which was trying to make ISPs liable for the downloading habits of their customers.

“You can breach copyright in two ways. One is by directly breaching it, which the users did; and secondly you can authorise a breach of copyright, which you can sometimes do by putting people in a position where they can breach copyright,” Mr Lambrick said.

“Now what Australian Federation Against Copyright Theft (AFACT) had argued was that by providing its internet service, iiNet was putting its account holders in a position whereby they could breach copyright directly themselves.

“Justice Cowdroy found it wasn’t the ISP’s system that was responsible for the breach of copyright. It was actually the BitTorrent system which was the means by which copyright was breached.”

Ruling: No Court Can Hear Abuse and Wrongful Death Claims from Guantanamo
February 17, 2010 Center for Constitutional Justice New York — Yesterday evening, the district court in Washington, D.C. ruled against two men who died in Guantanamo in June 2006 and their families in a case seeking to hold federal officials and the United States responsible for the men’s torture, arbitrary detention and ultimate deaths at Guantaacute;namo. Following a two-year investigation, the military concluded that the men had committed suicide. Recent first-hand accounts by four soldiers stationed at the base at the time of the deaths, however, raise serious questions about the cause and circumstances of the deaths, including the possibility that the men died as the result of torture. In dismissing the case, the district court ruled that the deceased’s constitutional claims that it was a violation of due process and cruel treatment to detain them for four years without charge while subjecting them to inhumane and degrading conditions of confinement and violent acts of torture and abuse, could not be heard in federal court. The men were held on the basis of an enemy combatant finding by a Combatant Status Review Tribunal later found by the Supreme Court itself to be inadequate. SEE ALSO, at CCR: [Ed. The biggest success of the tour was the Wellington presentation by Richard Gage, which drew a crowd of close to a thousand.

The New Zealand leg of the tour also enjoyed extensive coverage from major media, including Wellington broadsheet The Capital Times, and a 36  minute interview on Radio New Zealand.

In the second half we return to the raging debate over climate change which is now dominating Australian politics, and we take a look at the latest scandal over the release of thousands of private emails between top climate change scientists showing evidence of collusion to deceive the public and undermine sceptics.

In the final section we take a brief look at the work of Jewish historian Shlomo Sand, who argues that the Israeli state has been built on the foundations of myth and falsehood.
